Minister calls on protected tenants, property owners to apply for registration

(Hina) - Physical Planning, Construction and State Assets Minister Branko Bačić on Thursday called on property owners and protected tenants to apply to be entered into a register of privately owned flats occupied by protected tenants in order to be able to exercise their rights.

Registration is possible until 15 July under a public call that was published on 24 April, following the entry into force on 2 April of a law on the enforcement of the judgment by the European Court of Human Rights in the Statileo v. Croatia class action and the related decision by the Croatian Constitutional Court.

Protected tenants are persons who in the Yugoslav socialist system were given tenancy rights in privately owned flats.

Application for registration is obligatory if the property owner (co-owner) is a foreign natural person or company, while it is not necessary if the flat is owned by the state, a local government unit or a state-owned institution.

Registration is obligatory for owners and protected tenants, which means that those who do not apply to be entered in the register will not be able to exercise their rights under the law on the enforcement of the judgment by the European Court of Human Rights in the Statileo v. Croatia class action and the related decision by the Croatian Constitutional Court.

By registering, property owners can take possession of their flat or, as of 1 May 2025, have the right to receive a rent in the amount of €7.5 to 9.375 per square metre, sell the flat to the state or have it replaced with another property and receive solidary compensation.

Protected tenants acquire the right of ownership under favourable conditions, the possibility to receive a payment instead of being provided with housing, the possibility of provision of permanent housing in a state-owned flat, with the rent amounting to €2 per square metre, as well as the coverage of the cost of moving (for vulnerable groups - disabled persons, people above 65 and social welfare beneficiaries) in the amount of €1,000.

Applications to be entered in the register can be submitted at the Physical Planning, Construction and State Assets Ministry, by e-mail or registered post, as well as at the Administration for Real Estate Management in Split.
