State Commission for Supervision of Public Procurement Procedures rejects appeals over Vjesnik

Today the State Commission for the Supervision of Public Procurement Procedures published the decisions to reject appeals made by JONING d.o.o. and V.D.M. PROMET d.o.o. over the selection of a contractor to develop project documentation and to demolish the Vjesnik high-rise. According to the decisions, the Ministry of Physical Planning, Construction and State Assets will sign the contract with EURCO d.d. in the coming days to safely remove the Vjesnik high-rise as soon as possible and to safely open traffic in both directions at the underpass on Slavonska Avenue.

Let us recall that competent emergency services responded to the scene immediately after the fire that broke out on the evening of November 17, 2025, in the Vjesnik high-rise, which spread vertically across multiple floors and the roof of the building. As early as the next morning, an expert team was assembled, consisting of experts from the HCPI-IS and fire and structural assessment experts from the Faculty of Civil Engineering in Zagreb. In the days that followed, detailed inspections of the building were conducted, a safety perimeter was secured, and urgent meetings were held with co-owners and other competent authorities.

The report from November 23, 2025, on the structural condition of the building following the event determined that the building’s mechanical resistance and stability had been significantly compromised and that there was a risk a part of the building or the entire structure would collapse due to damage. Consequently, urgent removal of the building was suggested. Construction inspectors from the State Inspectorate declared the building dangerous, and following inspection, a decision was issued to order the development of project documentation and the building’s removal to co-owners.

Taking all the established circumstances in account, together with the estimated risk to people’s lives and health, to the environment and property, the Ministry initiated negotiations without prior publication of a call to bid, pursuant to Article 131 (1)(3) of the Public Procurement Act. The procedure was initiated due to the cumulative fulfilment of the following prerequisites: extreme urgency caused by an event the contracting authority could not have foreseen, where the resulting circumstances were not caused by the contracting authority and the deadlines prescribed for regular public procurement procedures were not applicable.

The estimated value of the procurement was 5,000,000.00 euro, VAT excluded. Once the bids were examined and assessed, on January 8, 2025, a decision was issued on the selection of the most economically advantageous bid submitted by EURCO d.d. in the amount of 4,220,000.00, VAT excluded, or 5,275,000.00, VAT included. The deadline to complete the first phase of works, including the removal of immediate danger and reopening of the underpass on Slavonska Avenue, is 30 days, while the overall completion deadline is three months. A voluntary ex ante transparency notice was also published.

Following the Ministry’s decision, the appeals were submitted to the State Commission for the Supervision of Public Procurement Procedures by JONING d.o.o. and V.D.M. PROMET d.o.o. In accordance with the Public Procurement Act, a submitted appeal prevents the conclusion of a public procurement contract until the State Commission issues a decision. Consequently, the Ministry postponed the conclusion of the contract and notified the public that, upon receiving the decision, it will act in accordance with its content and valid legislation.
