Scope of the Ministry

​At its session of 22 July 2020, the Croatian Parliament adopted the Act on the Structure and Scope of State Administration Bodies (Official Gazette 85/20), which establishes state administration bodies and determines their scope.

The scope of the Ministry of Physical Planning, Construction and State Assets is laid down in Article 18 of the Act.

The Ministry of Physical Planning, Construction and State Assets conducts administrative and other affairs related to physical planning, construction and housing, and participates in the preparation and implementation of programmes financed from EU funds and other forms of international assistance in these areas.

The Ministry conducts administrative and other affairs related to: physical planning of the Republic of Croatia and spatial development harmonization, planning, use and protection of the space, achieving international cooperation in physical planning, physical planning information system, monitoring of the situation in space and implementation of spatial plans of the Republic of Croatia, location permits, development and monitoring the implementation of the Spatial Development Strategy of the Republic of Croatia, the State Plan for Spatial Development and other spatial plans adopted by the Croatian Parliament or Government, preparation of a list of indicators on the situation in space, preparation or conducting the preparation of the report on the situation in space of the Republic of Croatia, cooperation at the development of spatial plans of counties, cities and municipalities in order to achieve the conditions for the management, protection and administration of the space and harmonization of the activities of state administration bodies participating in the development, adoption and implementation of spatial plans, realisation of the conditions for the development and promotion of the operation of legal and natural persons in the field of physical planning, development of settlements and development and use of building land.

The Ministry conducts administrative and other affairs related to the field of property valuation, establishing conditions for design and construction of construction works, energy efficiency in buildings, building and use permits, use, maintenance and removal of buildings.

The Ministry conducts administrative and other affairs related to the effect of economic policy instruments and measures on the development of design services in construction and construction services; operation of legal and natural persons in the field of construction, work of the professional chamber of architects and chambers of civil engineers in construction and physical planning, freedom of movement of construction products and services within the prescribed competence of the Ministry, regulation of requirements for energy efficient, affordable and sustainable building, monitoring and analysis of the legality and quality of building; monitoring of construction; monitoring and analysis of quality of construction and design services in construction; housing, housing policy, housing and settlement construction; realization of special government programmes in housing construction; policy, monitoring and promoting the situation in the utility sector, realisation of international cooperation in construction and housing.

The Ministry conducts administrative and other affairs related to the management of state assets that are entrusted to it for management pursuant to a special act.

The Ministry exercises ownership powers on behalf of the Republic of Croatia pursuant to a special act governing the management of state assets.

The Ministry develops a draft proposal of the State Assets Management Strategy, a proposal of the Annual State Assets Management Plan and a proposal of the Report on Implementation of the Annual State Assets Management Plan.

The Ministry conducts professional affairs related to coordination and harmonization of criteria for management of state assets with which the Ministry has been entrusted, establishes guidelines for the realisation of the ownership policy in legal entities of special interest to the Republic of Croatian, and monitors the operation, management, development and strategic policy realisation in these companies. The Ministry proposes to the Government the adoption of a decision on establishing the list of legal entities of special interest to the Republic of Croatia.

The Ministry, pursuant to regulations governing state assets management, proposes to the Government to appoint members of the board, supervisory board and managing board of those legal entities of special interest to the Republic of Croatia that engage primarily in activities in the field under the competence of this Ministry; the Ministry proposes to the Government to take decisions on the manner of disposal of shares or business shares of legal entities of special interest to the Republic of Croatia that engage primarily in activities in the field under the competence of this Ministry, and participates in restructuring, recapitalisation and other similar procedures for these legal entities of special interest to the Republic of Croatia.

The Ministry conducts affairs of improving corporate governance of legal entities owned by the Republic of Croatia; it performs activities of training supervisory boards members for performing affairs of supervisory board members of companies.

The Ministry conducts administrative and other affairs related to the management and disposal of the stock of apartments and business premises owned by the Republic of Croatia in respect of which management is not governed by special regulation; management and disposal of residential facilities, management and disposal of real estate declared by the Ministry of Defence prospectiveless for military purpose, and management and disposal of other building land owned by the Republic of Croatia; management and disposal of land owned by the Republic of Croatia on which campsite activity is carried out, or on which a mountain lodges or a houses with appertaining land is built for regular use of the property, built on land registered as property of the Republic of Croatia, regardless of whether it is located in a construction zone, on agricultural land, forest or forest land, if in the procedure of public property conversion or pursuant to special regulations other persons have not acquired property, real estate owned by the Republic of Croatia planned for the construction of golf courses, hotels, hotel complexes, campsites and other outdoor sports and recreational playgrounds with accompanying buildings and other similar facilities of a commercial nature, management and disposal of assets owned by the Republic of Croatia or over which the Republic of Croatia exercises proprietary rights, and which are associated with legal persons and are the subject of succession of states resulting from the dissolution of the former Socialist Federal Republic of Yugoslavia pursuant to special regulations; with regard to these properties, the Ministry passes decisions on acquisition, replacement and other similar disposal.

The Ministry manages surplus mineral raw material excavation in accordance with special regulations.

The Ministry manages assets that have been permanently confiscated by a valid court judgment in criminal or misdemeanour proceedings from finally convicted perpetrators of a criminal offence or misdemeanour, or persons associated with them, and with the management of which the Ministry has been entrusted; it manages temporarily confiscated assets owned by defendants against whom criminal or misdemeanour proceedings are being conducted or persons associated with them pursuant to special regulations and with the management of which the Ministry has been entrusted.

The Ministry participates in the process of drafting physical planning documents by submitting requests and issuing opinions, if thereby also land owned by the Republic of Croatia and managed by the Ministry is covered.

In implementing the act governing state asset management, the Ministry supervises management and disposal of state assets.

The Ministry participates in the work of European Union institutions and cooperates with other international institutions in accordance with its prescribed competence and scope.

The Ministry conducts affairs related to the participation of the Republic of Croatia in the work of European Union bodies in the fields under its competence.

The Ministry also conducts other affairs which are placed under its competence by special law.
