Regulations in the filed of construction products

On 4 April 2011, Regulation (EU) No 305/2011 was published in the Official Journal of the European Union.

This Regulation governs the repeal of Council Directive 89/106 / EEC, with the transitional and final provisions of Regulation (EU) No 305/2011 extending the application of Council Directive 89/106/EEC until 30 June 2013. Regulation (EU) No 305/2011 sets 1 July 2013 as the date after which the placing on the market and movement of construction products in the European Economic Area and the business operations of economic operators must in that regard comply with Regulation (EU) No 305/2011. Regulation (EU) No 305/2011 also provides for a transitional period from 24 April 2011 to 30 June 2013, during which, inter alia, the operations of economic operators must be aligned with the Regulation.

As the area of construction products at the level of the European Union is regulated by the aforementioned Regulation as a secondary source of European Union law, which will be directly and fully applicable in the Republic of Croatia on the day of Croatia's accession to the European Union, it was necessary to adopt a new legislative proposal that constitutes a mechanism for its implementation.

The adoption of the new Construction Products Act (Official Gazette 76/13, 30/14, 130/17, 39/19, 118/20) repealed the Construction Products Act (Official Gazette 86/08 and 25/13) and transposed Council Directive 89/106/EEC into the Croatian legal system. The Construction Products Act (Official Gazette 76/13, 30/14, 130/17, 39/19, 118/20) regulates the manner of application of Regulation (EU) No 305/2011 for the purposes of placing on the market and movement of construction products within the European Economic Area, as well as other issues related to construction products in the non-harmonised area in the territory of the Republic of Croatia.

On the day of entry into force of this Ordinance (12 December 2019) the Ordinance on conformity assessment, conformity documents and marking of construction products (Official Gazette 103/08, 147/09, 87/10, 129/11), shall cease to be valid, except for the provisions of Article 4(4) and (5), Article 16 and Table 1 of these Rules and the Rules on technical approvals for construction products (Official Gazette No 103/08).

On the day of entry into force of the new Technical regulation for building structures (4 March 2017), the following Technical Regulations ceased to be valid, except that the standards from the lists contained in these Technical Regulations relating to the non-harmonised area of construction products apply until a special regulation is adopted which regulates construction products provided that they are not in conflict with the Technical Regulation on Construction Products (Official Gazette 33/10, 87/10, 146/10, 81/11, 100/11 and 130/12, 81/13, 136/14 and 119/15).
 
Furthermore, the main design of the construction work in which the technical solution of the building structure is given according to these Technical regulations is considered a valid document for issuing acts permitting construction if the application for issuing that act together with the main design is submitted within six months from the date of entry into force of the new Technical regulation for building structures.
