Requirements prescribed for legal persons

A LEGAL PERSON registered for activities of energy certification and energy audits of buildings, and applying for obtaining authorisation for: 
  • energy certification and energy audits of buildings with a simple technical system;
  • energy certification of buildings with a complex technical system;
  • carrying out energy audits of buildings with a complex technical system – in the part relating to:
    1. construction part of the building;
    2. mechanical part of the technical system;
    3. electrical part of the technical system;
    4. automatic regulation and control systems;
  • regular inspections of heating systems and cooling or air-conditioning systems in buildings
shall enclose to the application form - presented in Annex 1B to the Ordinance on persons authorised for energy certification, energy audits of buildings and regular inspections of heating systems and cooling or air-conditioning systems in buildings (Official Gazette 73/15) (hereinafter: Ordinance) the following:
  1. copies of unlimited employment contracts for persons who shall perform energy audits of buildings, energy certification, and regular inspections of heating systems and cooling or air-conditioning systems in buildings,
     
  2. appointment of a person who shall sign energy audit reports of buildings, energy certificates of buildings, and reports on regular inspections of heating systems and cooling or air-conditioning systems in buildings (completed form presented in Annex 1D to the Ordinance)
     
  3. the below proof for the appointed and other employed persons (proof shall be enclosed for all natural persons who at the legal person shall perform energy audits of buildings, energy certification, and regular inspections of heating systems and cooling or air-conditioning systems in buildings):

    3.1. a copy of both sides of the identity card

    3.2. a copy of the diploma of completed study proving that the natural person has:

    - completed a graduate university study programme of the architectural, civil engineering, electrical engineering or mechanical engineering profession, or a specialist graduate professional study programme of the architectural, civil engineering, electrical engineering or mechanical engineering profession, during which he earned at least 300 ECTS;

    - or, according to earlier educational programmes, has achieved the academic title of a graduate engineer of a technical profession: architectural, civil engineering, mechanical engineering, electrical engineering

    - for granting authorisation to perform energy certification and energy audits of buildings with a simple technical system - completed undergraduate university or undergraduate professional study programme of the architectural, civil engineering, electrical engineering or mechanical engineering profession, or according to earlier educational programmes, has achieved the academic title of engineer of the architectural, civil engineering, mechanical engineering or electrical engineering profession.

    3.3. a copy of the certificate of successfully completed Basic Training programme / Training programme prescribed by the Ordinance:

    - if application is submitted for granting authorisation to perform energy certification and energy audits of buildings with a simple technical system - certificate of successfully completed Module 1;

    - if application is submitted for granting authorisation to perform energy certification and energy audits of buildings with a complex technical system - certificate of successfully completed Module 1 and Module 2;

    3.4. a copy of the certificate by the Croatian Pension Insurance Institute on the employee’s employment status and years of service

    3.5. the description of the field of work –  a minimum of five years of professional work experience - enclosed in the table from Annex 1C to the Ordinance

    In the table data shall be indicated in chronological order, indicating tasks on which the person worked (at least five years of professional work experience or two years of work experience in designing or/and performance of building surveillance shall be singled out, with one example for each of the five calendar years), and persons who completed an undergraduate university or undergraduate professional study programme of the architectural, civil engineering, mechanical engineering or electrical engineering profession, or who according to earlier educational programmes have achieved the title of engineer of the architectural, civil engineering, mechanical engineering or electrical engineering profession (higher qualification level), and have at least ten years of work experience in their professional field or five years of work experience in designing or/and performance of building surveillance, shall enclose the description of their work experience in the table from Annex 1C for at least ten years of work experience or five years of work experience in designing or/and performance of building surveillance, with one example for each of the ten calendar years.

    Enclosure 1C shall be signed personally and provided with the seal of certified engineer and/or expert witness, if the natural person has a seal, and copy of the decision on entry in the register of certified engineers of the respective profession or copy of the decision on suspension of membership in the chamber shall be submitted. This form does not have to be provided with the seal of the legal person.
  4. Certificate of no criminal record for the legal person and responsible person with the legal person, issued by the competent Municipal Court

  5. A copy of the insurance contract or insurance policy against professional liability for damage for the legal person:

    The insurance contractor and insured person shall be the same legal person – the applicant (without indicating natural persons).

    The subject of insurance is insurance against liability for potential damage the legal person could cause when performing tasks of energy audits of buildings and/or energy certification of buildings to the investor, owner or other persons.

    The insurance period shall be at least until the expiration date of the decision on authorisation, that is, five years.

    The insurance contract shall be provided with seal and signature of the insurance company and the signature of the responsible person with the legal person.
     
  6. Administrative fee in the amount of 70 kuna in revenue stamps affixed on the application.

 

Reissuing of authorisation for legal persons

An authorised person shall submit the application for reissuing of authorisation to the Ministry within at least one months, and no longer than two months before the expiry of the authorisation.

The following shall be enclosed:

  1. An application form for legal persons (Annex 1B of the Ordinance)
    The application must be in written or/and electronic form in capital letters, with seal of the legal person and signature of the responsible person with the legal person submitting the application.
  2. A copy of the certificate by the Croatian Pension Insurance Institute on the employees’ employment status and years of service
  3. A copy of the legal person’s insurance contract or insurance policy against professional liability for damage
  4. Evidence of no criminal record for the legal person and the responsible person with the legal person, issued by the competent Municipal Court
  5. Appointment of the person authorised to sign reports on energy audits of buildings, energy certificates of buildings, reports on regular inspections of heating systems and cooling or air-conditioning systems in buildings (completed form provided in Annex 1D of the Ordinance)
  6. Copies of the certificate of successfully completed Training programme prescribed by the Ordinance, for all appointed persons and other employees who in authorised legal persons carry out energy certification, energy audits of buildings and regular inspections of heating systems and cooling or air-conditioning systems in buildings.
    Appointed persons and other employees who in authorised legal persons carry out energy certification, energy audits of buildings and regular inspections of heating systems and cooling or air-conditioning systems in buildings shall once a year attend the Training programme according to the Ordinance.
  7. Administrative fee in the amount of 70 kuna in revenue stamps affixed on the application.

 

Special note regarding requirements prescribed for legal persons:

Legal persons authorised on the basis of an application submitted by 31 December 2013, inclusive, shall when submitting the application for reissuing of authorisation, enclose at least two Certificates of Training programme attendance for every appointed person and other employee who in authorised legal persons carry out energy certification, energy audits of buildings and regular inspections of heating systems and cooling or air-conditioning systems in buildings.

Legal persons authorised on the basis of an application submitted since 01 January 2014, when submitting the application for reissuing of authorisation, shall enclose at least three Certificates of Training programme attendance for every appointed person and other employee who in authorised legal persons carry out energy certification, energy audits of buildings and regular inspections of heating systems and cooling or air-conditioning systems in buildings.

Persons who have successfully completed Training programmes Module 1, or Module 1 and Module 2, and have not submitted the applications for appropriate authorisation within one year from the date of the exam, may submit such application along with enclosing the Certificate on attendance of the Training programme in accordance with the Ordinance, under the condition that the period from the date of completed Training programme until the date of application submission is not longer than one year.
 

Changes during period of authorisation validity

In the case of change of name, address or authorised person in the authorised legal person, the authorised person shall notify the Ministry within 8 days from the occurred change, and submit an application for amendment to the decision:

  1. An application form for legal persons (Annex 1B of the Ordinance)
    The application shall be in written or/and electronic form in capital letters, with affixed seal of the legal person and signed by the responsible person in the legal person submitting the application.
  2. A copy of the decision on authorisation
  3. Evidence of change of name, address or authorised person (copy of the decision on entry in the court register)
  4. Administrative fee in the amount of 70 kuna in revenue stamps affixed on the application.
